These Terms and Conditions (“Terms”) govern your access to and use of the SmutVibes website, application, services, features, and related platforms (collectively, the “Service”). By creating an account, accessing, or using SmutVibes, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility and Adults-Only Requirement

SmutVibes is intended exclusively for adults.

You must:

• Be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher;

• Have the legal capacity to enter into these Terms;

• Not be prohibited from using the Service under applicable law; and

• Provide accurate age and account information.

Minors are strictly prohibited from using SmutVibes or appearing in any content uploaded, shared, streamed, or otherwise made available through the Service. We may request age or identity verification and may suspend or terminate accounts that fail verification or appear to violate this requirement.

2. Acceptance of These Terms

By using the Service, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, Community Guidelines, and any other policies referenced in these Terms. These documents form part of your agreement with SmutVibes.

We may update these Terms from time to time. Updated Terms will be posted through the Service with a revised “Last Updated” date. Your continued use of SmutVibes after changes become effective constitutes acceptance of the revised Terms.

3. Your Account

You may need to create an account to access certain features. You agree to:

• Provide truthful, current, and complete information;

• Keep your account information accurate and updated;

• Maintain the confidentiality of your login credentials;

• Use only your own account;

• Notify us promptly of unauthorized access or suspected security issues; and

• Accept responsibility for activity conducted through your account.

You may not impersonate another person, create an account for someone else without authorization, use a misleading identity, or create multiple accounts to evade enforcement actions.

We reserve the right to refuse registration, suspend, or terminate accounts at our discretion, subject to applicable law.

4. User Content

“User Content” means any text, image, video, audio, profile information, message, comment, livestream, link, or other material you submit, upload, publish, transmit, or otherwise make available through the Service.

You retain ownership of your User Content. However, by submitting User Content, you grant SmutVibes a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, adapt, display, distribute, and make your User Content available as necessary to operate, maintain, improve, promote, and provide the Service.

This license ends within a commercially reasonable period after you delete your User Content, except where retention is necessary for legal compliance, dispute resolution, security, backup, or enforcement of these Terms.

You represent and warrant that:

• You own or have the necessary rights and permissions to submit the User Content;

• You have obtained all required consents from identifiable individuals depicted or referenced in the content;

• The User Content does not violate any law or third-party rights;

• The User Content does not contain or depict minors in sexual or exploitative contexts;

• The User Content is not nonconsensual, exploitative, or unlawfully intimate; and

• The User Content complies with these Terms and our Community Guidelines.

You are solely responsible for your User Content and the consequences of publishing it.

5. Prohibited Conduct and Content

You may not use SmutVibes to:

• Violate any applicable law, regulation, court order, or third-party right;

• Upload, request, distribute, or promote child sexual abuse material or any sexual content involving minors;

• Facilitate grooming, trafficking, exploitation, prostitution, or sexual abuse;

• Share intimate or sexual content without the subject’s informed consent;

• Threaten, harass, stalk, intimidate, blackmail, extort, or abuse another person;

• Publish personal, private, or identifying information without authorization;

• Impersonate another person or misrepresent your affiliation;

• Promote violence, terrorism, or credible threats of harm;

• Encourage self-harm or harm to others;

• Engage in fraud, scams, phishing, money laundering, or deceptive activity;

• Infringe copyrights, trademarks, privacy rights, publicity rights, or other intellectual property rights;

• Distribute malware, viruses, spyware, or other harmful code;

• Scrape, crawl, harvest, or collect information from the Service without authorization;

• Circumvent security, access controls, age restrictions, or account limitations;

• Use bots, automated systems, or unauthorized third-party tools;

• Sell, transfer, or share your account;

• Use the Service for unauthorized commercial solicitation or spam; or

• Attempt to interfere with, disrupt, overload, or damage the Service.

Sexually explicit content may be subject to additional restrictions, age-gating, labeling, geographic limitations, payment-provider requirements, or removal under our policies and applicable law.

6. Consent and Personal Responsibility

SmutVibes supports consensual adult expression. Consent must be informed, voluntary, specific, and ongoing. Consent may be withdrawn at any time.

You are responsible for communicating clearly, respecting boundaries, and ensuring that your interactions comply with applicable law. SmutVibes does not verify the identity, age, intentions, or representations of every user. Exercise caution when communicating, meeting, sending money, or sharing personal information with others.

Never send money, intimate material, passwords, identification documents, or financial information to another user unless you fully understand the risks.

7. Moderation and Enforcement

We may, but are not obligated to, monitor, review, restrict, remove, disable access to, or preserve User Content and accounts that we believe may violate these Terms, our policies, or applicable law.

We may take actions including:

• Issuing warnings;

• Removing or restricting content;

• Limiting account features;

• Suspending or terminating accounts;

• Blocking devices, identifiers, or access methods;

• Reporting suspected illegal activity to authorities; and

• Preserving information where legally required or reasonably necessary.

We may take action without prior notice, as necessary, to protect users, the Service, or third parties. We do not guarantee that all prohibited content or conduct will be detected or prevented.

8. Reporting Violations

You may report suspected violations through the reporting tools or contact methods provided by SmutVibes. Reports should include sufficient information for us to investigate.

Submitting a report does not guarantee removal or any particular outcome. False, malicious, or abusive reports may result in enforcement action.

If you believe content involves child exploitation, imminent danger, or another serious crime, contact the appropriate emergency services or law enforcement authority in addition to reporting it to SmutVibes.

9. Intellectual Property

The Service, including its software, design, branding, logos, text, graphics, features, and other materials provided by SmutVibes, is owned by or licensed to SmutVibes and is protected by intellectual-property laws.

Subject to these Terms, SmutVibes grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, lawful purposes.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, create derivative works from, or exploit any part of the Service without prior written permission, except where such restrictions are prohibited by law.

10. Copyright Complaints

If you believe content on SmutVibes infringes your copyright, you may submit a notice containing:

• Your name and contact information;

• Identification of the copyrighted work;

• Identification and location of the allegedly infringing material;

• A statement that you have a good-faith belief that the use is unauthorized; and

• A statement, made under penalty of perjury where applicable, that the information is accurate and that you are authorized to act.

Notices may be sent to: support@smutvibes.net.

We may remove allegedly infringing content and may terminate repeat infringers where appropriate.

11. Third-Party Services and Links

The Service may contain links to or integrations with third-party websites, applications, payment processors, or services. SmutVibes does not control and is not responsible for third-party services, content, policies, security, or practices.

Your use of third-party services is governed by the applicable third party’s terms and policies.

12. Paid Features and Subscriptions

Certain features may require payment, including subscriptions, purchases, tips, or other transactions. Prices, billing terms, renewal terms, and applicable taxes will be disclosed before purchase.

Unless otherwise stated:

• Subscriptions may automatically renew until canceled;

• You authorize the applicable payment provider to charge your selected payment method;

• You are responsible for keeping payment information current;

• Fees are non-refundable except where required by law or expressly stated; and

• Cancellation generally prevents future charges but does not automatically refund prior charges.

Payment processing may be handled by third-party providers. Their terms and privacy policies may also apply.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using SmutVibes, you acknowledge that your information may be collected, used, stored, and disclosed as described in that policy and as permitted by applicable law.

You should carefully consider what information you publish or share because content posted publicly or shared with others may be copied, saved, or redistributed.

14. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. SmutVibes makes no warranties, express or implied, regarding:

• The availability, reliability, accuracy, or security of the Service;

• The identity, age, conduct, or intentions of users;

• The accuracy or legality of User Content;

• The suitability of the Service for any particular purpose;

• The prevention of unauthorized access, harmful content, or security incidents; or

• The uninterrupted or error-free operation of the Service.

You use the Service at your own risk. SmutVibes is not responsible for interactions, meetings, transactions, or relationships between users.

15. Limitation of Liability

To the maximum extent permitted by law, SmutVibes and its owners, affiliates, officers, directors, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, privacy, or business opportunities arising from or related to:

• Your use of or inability to use the Service;

• User Content or conduct;

• Unauthorized access to your account or information;

• Third-party services or links;

• Transactions or communications between users; or

• Any other matter relating to the Service.

To the maximum extent permitted by law, SmutVibes’ total liability for claims arising from or related to the Service will not exceed the greater of the amount you paid to SmutVibes during the twelve months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

16. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless SmutVibes and its owners, affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from or related to:

• Your use of the Service;

• Your User Content;

• Your violation of these Terms or applicable law;

• Your violation of another person’s rights; or

• Your conduct or interactions with other users.

17. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access if we believe you have violated these Terms, our policies, applicable law, or created risk or potential legal exposure for SmutVibes or others. We may also discontinue all or part of the Service at any time.

Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination will remain in effect, including provisions concerning User Content licenses, intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.

18. Dispute Resolution

Before filing a formal claim, you agree to contact SmutVibes at support@smutvibes.net and provide a written description of the dispute and the relief requested. You and SmutVibes agree to attempt to resolve the dispute informally for at least 30 days.

To the extent permitted by law, disputes arising from or relating to these Terms or the Service will be governed by the laws of Jamaica, without regard to conflict-of-law principles. The courts located in Kingston JA will have exclusive jurisdiction unless applicable law provides otherwise.

If your jurisdiction does not permit a particular dispute-resolution provision, that provision will be applied only to the extent legally permitted.

19. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time, including features, content, availability, or pricing. We are not liable for any modification, suspension, or discontinuation, except where liability cannot be excluded by law.

20. General Terms

These Terms, together with the Privacy Policy, Community Guidelines, and other referenced policies, constitute the entire agreement between you and SmutVibes regarding the Service.

If any provision is found invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of law.

Nothing in these Terms creates a partnership, agency, employment, fiduciary, or joint-venture relationship between you and SmutVibes.
